Mendoza is the second province of the country with more real estate, and does not have a local legal regulation that regulates them in a systematic, coordinated and sufficient manner. It is detected that those that exist before to the current legal regime suffer from difficulties to adapt to the new regulations of national order; and that not even the regulations of administration, construction, coexistence, discipline, etc., whose compliance must be observed by the owners and all the people who inhabit these urbanizations by virtue of the contractual provisions stipulated, are advertised in the Real Property Registry generating a notorious lack of legal security. As for those that have been projected after the new Code has been in force, they present some difficulties in the administrative cadastral, municipal and other public and private entities involved in authorizations process for their occupation and provision of services. Therefore, this research has as its main objective to study and analyze the national and provincial legislation and the problem of Mendoza in order to this phenomenon, and propose a comprehensive provincial legal regime of the Real Estate. This regime must contemplate not only the general interest, but also that of all the subjects that intervene in the development, commercialization and acquisition of the units of these complexes; coordinating the registration, environmental or urban aspects, with the economic and social, adjusting to the national legislation and to the guidelines of the laws of provincial territorial ordering; conferring certainty and speed to the real estate legal traffic.
